Acceptance of Terms
This TOS is a legally binding agreement that shall govern the relationship with the users and other legal entities which may interact or interface with Oasis Land Development ( “Oasis Development” “we” “us” “our”), in association with the use of our website http://www.oasis-land.com (the “Site”) owned, operated and managed us. By using the site you acknowledge and represent that you:
a) Have read and understand these TOS;
b) Are 18 years of age or older; and
c) Accept these TOS and agree that they are an agreement between you and Oasis Development.
Please read the following Terms of Service (“TOS”) carefully. If you do not agree to any or all the TOS, you are not allowed to access the Site or use any of the services. By accessing or using our Site, you hereby agree to be bound by all the terms stipulated herein below and incorporated herein by reference. It is your responsibility, the user, customer, or prospective customer to read the TOS before proceeding to use this site. The term ‘you’, ‘user’, ‘customer’ or ‘prospective customer’ may be used interchangeably in the TOS, however shall refer to mean the same.
Changes to the Terms of Services
We may revise and update these TOS from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Site thereafter. Your continued use of the Site following the posting of revised TOS means that you accept and agree to the changes. You further waive any right you may have to receive specific notice of such changes to these TOS. As a user of the Site, it is your responsibility to regularly review these TOS.
The Site and its Content
Oasis Development is a leading real estate development company in Cayman Islands, with a wide range of freehold land lots available across all three Islands, including ocean front, ocean view, lake side & garden view locations. The Site is designed to provide you with access to residential and commercial real estate listings, real estate related information, and information about our real estate development projects. The Site is intended to assist prospective customers who may be interested in acquiring properties within Cayman Islands. Prospective customers are reminded that purchasing property is a major financial commitment. As a result, you should take all reasonable steps to ensure that any property that you are planning to purchase through our Site is suitable for your requirements in all respects. The Site and its contents are presented in good faith and we have made all reasonable efforts to ensure that material available on the Site is accurate but it is emphasized that prospective clients should make further enquires about the properties they are
proposing to purchase, including but not limited to site visits, discussions with our sales office, independent legal and financial advice.
Oasis Development reserves the right to access and use the Site, and any content and information therein, to the extent necessary to run the Site and makes it available to you and others, to protect the Site, and to evaluate and improve the Site.
The layout, formatting, and features of and access privileges for the Site shall be as determined or specified by Oasis Development in our sole discretion. We shall also have the sole right to modify, upgrade, and change the Site. Oasis Development will not be liable if for any reason all or any part of the Site or its content is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Site, or the entire Site, to users, in our sole discretion. We may terminate your access to and use of the Site, or any part of the Site, for any reason, with or without notice.
Please be advised that Oasis Land Development is not a financial advisor, financial institution, investment advisor, or tax advisor. Our primary role is to facilitate the buying and selling of land in the Cayman Islands. The content provided by Oasis Land Development, including but not limited to our website, brochures, and all communication, is for informational purposes only and does not constitute financial, tax, or legal advice.
Linking to Third Party Websites
The Site and the information contained on it is provided on an as-is basis and Oasis Development shall not be liable to you in respect of the Site or the use, accessing, downloading or relying on any information contained or referred to on the Site. Oasis Development excludes all liability to the fullest extent permitted by law whether in contract (including under any indemnity or warranty), in tort (including negligence), under statute or otherwise for (but not limited to) any loss of profit, loss of revenue, loss of anticipated savings, loss or corruption of data due to viruses or otherwise, loss of contract or opportunity, loss of goodwill or indirect or consequential loss of whatever nature including (without limit) any loss of a type described above which could be regarded as indirect or consequential and whether or not reasonably foreseeable by you, a third party or us in connection with the Site. While Oasis Development makes reasonable attempts to exclude viruses and other harmful components from the Site, its content or server, we cannot guarantee such exclusion and make no warranty, to the extent permitted by law, we exclude all liability for viruses which may be downloaded from the Site. We recommend that you take all appropriate safeguards prior to downloading information from the Site. We further exclude all implied warranties to the fullest extent permitted by Cayman Islands law.

NEITHER OASIS DEVELOPMENT NOR ANY PERSON ASSOCIATED WITH US MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SITE. WITHOUT LIMITING THE FOREGOING, NEITHER OASIS DEVELOPMENT NOR ANYONE ASSOCIATED WITH US REPRESENTS OR WARRANTS THAT THE SITE WILL OPERATE UNINTERRUPTED OR IN A MANNER THAT WILL MEET YOUR PARTICULAR REQUIREMENTS AND/OR NEEDS. TO THE FULLEST EXTENT PROVIDED BY LAW, OASIS DEVELOPMENT HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE. OASIS DEVELOPMENT ALSO DISCLAIMS ANY RESPONSIBILITY FOR THE CONTENT, THE MATERIALS, THE ACCURACY OF THE INFORMATION, AND/OR THE QUALITY OF THE INFORMATION PROVIDED BY OR AVAILABLE THROUGH THE SITE.
THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
Limitation on Liability
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL OASIS DEVELOPERS, ITS SHAREHOLDERS, DIRECTORS, AFFILIATES, OFFICERS, AGENTS AND EMPLOYEES, LICENSORS, SERVICE PROVIDERS, AND ALL THIRD PARTIES THAT PROVIDE CONTENT, INFORMATION TO THE SITE BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY APPLICATIONS LINKED TO IT, OR ANY CONTENT ON THE SITE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.
THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
Intellectual Property and Copyright
Without prejudice to the generality of these TOS, users of the Site are strictly prohibited from downloading or recirculating material obtained from the Site. You acknowledge and accept that all of the copyright, database rights and any other intellectual property rights are our property.

Waiver and Severability
No waiver by Oasis Developers of any term or condition set out in these TOS shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Oasis Developers to assert a right or provision under these TOS shall not constitute a waiver of such right or provision.
If any provision of TOS is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of TOS will continue in full force and effect.
All matters relating to the Site and these TOS, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of Cayman Islands, excluding any principles or rules of law that may direct the application of the law of another state.
These TOS constitute the sole and entire agreement between you and Oasis Developers regarding the Site and supersede all prior understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
